កិច្ចព្រមព្រៀងស្តីពីដែនទឹកប្រវត្តិសាស្ត្ររវាងសាធារណៈរដ្ឋសង្គមនិយមវៀតណាម និងសាធារណៈរដ្ឋប្រជាមានិតកម្ពុជា ( Agreement on the historical Waters between the socialist Republic of Vietnam and The People's Republic of Kampuchea)

រដ្ឋាភិបាលនៃសាធារណៈរដ្ឋសង្គមនិយមវៀតណាម និងរដ្ឋាភិបាលនៃសាធារណៈរដ្ឋប្រជាមានិតកម្ពុជា, 

ដោយក្តីសង្ឃឹមនៃការបង្រួបបង្រួម និងអភិវឌ្ឍន៍ទំនាក់ទំនងពិសេសវៀតណាម-កម្ពុជា ស្របតាមស្មារតីនៃសន្ធិសញ្ញាសន្តិភាព មិត្តភាព និងកិច្ចសហប្រតិបត្តិការដែលបានចុះហត្ថលេខានាថ្ងៃទី ១៨/២/១៩៧៩។

ផ្អែកលើការពិត ទឹករវាងឆ្នេរនៃខេត្តគៀនយ៉ាង កោះភូកុក ដល់កោះថូជូ នៃសាធារណៈរដ្ឋសង្គមនិយមវៀតណាម និងឆ្នេរសមុទ្រនៃខេត្តកំពត ដល់កោះពូឡូវៃ នៃសាធារណរដ្ឋប្រជាមានិតកម្ពុជា រួមមានទឹកដែលមាន ជាកម្មសិទ្ធិរបស់វៀតណាម និងកម្ពុជាយូរយារណាស់មកហើយ ដោយសារលក្ខខណ្ឌភូមិសាស្ត្រពិសេស និងអត្ថន័យសំខាន់របស់ពួកគេចំពោះវិស័យការពារជាតិ និងសេដ្ឋកិច្ចនៃប្រទេសនីមួយៗ។

មាត្រា ១

ទឹករវាងឆ្នេរនៃខេត្ត Kien Giang កោះ Phu Quoc ទៅកោះ Tho Chu នៃសាធារណៈរដ្ឋសង្គមនិយមវៀតណាម និងឆ្នេរសមុទ្រនៃខេត្តកំពតដល់កោះ Poulo Wai នៃសាធារណៈរដ្ឋប្រជាមានិតកម្ពុជា គឺជាទឹកប្រវត្តិសាស្ត្រនៃប្រទេសទាំងពីរក្រោមផ្ទៃ។ ស្ថានភាពទឹក មានកំណត់ (យោងទៅតាម Greenwich meridian)៖

ទៅ ពាយព្យ ដោយបន្ទាត់តភ្ជាប់ កូអរដោណេ 9°54'.2 ខាងជើង - 102°55' ខាងកើត និង 9°54'.5 ខាងជើង - 102°57'.0 ខាងកើត នៅកោះពូលូវ៉ៃ (កម្ពុជា) ដើម្បីសម្របសម្រួល 10°24 'ខាងជើង - 103°48.0 ខាងកើត និង 10°25'.6 ខាងជើង - 103°49'.2 ខាងកើតនៅកោះសស (កម្ពុជា) ដើម្បីសម្របសម្រួល 10°30.0 ខាងជើង - 103°47'.4 ខាងកើតនៅកោះថ្មី (កម្ពុជា) បានពង្រីកដើម្បីសម្របសម្រួល 10°32'.4 ខាងជើង - 103°48'.2 ខាងកើតឆ្នេរសមុទ្រ ខេត្តកំពត (កម្ពុជា )

ទៅខាងជើងជាប់មាត់សមុទ្រខេត្តកំពត ចាប់ពីកូអរដោនេ 10°32'.4 ខាងជើង - 103°48'.2 ខាងកើតដល់ចំណុចខ្លាំងលើឆ្នេរនៃព្រំប្រទល់ដីរវាងវៀតណាមនិងកម្ពុជា។

ទៅភាគអាគ្នេយ៍តាមខ្សែបន្ទាត់តភ្ជាប់ចំណុចខ្លាំងនៅលើឆ្នេរសមុទ្រនៃព្រំដែនដីគោករវាងវៀតណាមនិងកម្ពុជាដើម្បីសម្របសម្រួល 10°04'.2 ខាងជើង - 104°02'.3 ខាងកើតនៅ Cape An Yen Phu Quoc (វៀតណាម) តាមបណ្តោយ។ ឆ្នេរខាងជើងនៃកោះទៅ Cape Dat Do នៅកូអរដោនេ 10°02.8 ខាងជើង - 103°59'.1 ខាងកើតលាតសន្ធឹងតាមរយៈកូអរដោនេ 9°18'.1 ខាងជើង - 103°26'.4 ខាងកើតនៅកោះ Tho Chu (វៀតណាម) ដើម្បីសម្របសម្រួល 9°15'.0 ខាងជើង - 103°27'.0 ខាងកើតនៅកោះ Hon Nhan នៃកោះ Tho Chu (វៀតណាម)។

ទៅភាគនិរតីដោយខ្សែបន្ទាត់លាតសន្ធឹងពីកូអរដោណេ 9°55'.0 ខាងជើង - 102°53'.5 ខាងកើតនៅកោះពូលូវ៉ៃ ដើម្បីសំរបសំរួល 9°15'.0 ខាងជើង - 103°27'.0 ខាងកើតនៅកោះហន់ណាន កោះថូជូ (វៀតណាម)។

មាត្រា ២

ភាគីទាំងពីរនឹងពិភាក្សាក្នុងពេលវេលាសមស្របមួយ លើស្មារតីស្មើភាព និងស្មោះត្រង់ គោរពឯករាជ្យភាព និងអធិបតេយ្យភាពរបស់គ្នាទៅវិញទៅមក គោរពផលប្រយោជន៍ស្របច្បាប់របស់គ្នាទៅវិញទៅមក ដើម្បីឯកភាពគ្នាលើព្រំដែនសមុទ្ររវាងប្រទេសទាំងពីរក្នុងដែនទឹកប្រវត្តិសាស្ត្រដែលបានលើកឡើងក្នុងមាត្រា ១។

មាត្រា ៣

ខណៈពេលដែលរង់ចាំដោះស្រាយព្រំដែនសមុទ្ររវាងប្រទេសទាំងពីរក្នុងដែនទឹកប្រវត្តិសាស្ត្រដែលបានលើកឡើងក្នុងមាត្រា ១៖

ចំណុចជាប់ 0 នៃខ្សែបន្ទាត់មូលដ្ឋានទាំងពីរដែលប្រើសម្រាប់វាស់ទទឹងសមុទ្រនៃទឹកដីនៃប្រទេសនីមួយៗគឺស្ថិតនៅលើខ្សែតភ្ជាប់កោះ Tho Chu និងកោះ Poulo Wai ហើយនឹងត្រូវបានកំណត់ដោយភាគីទាំងពីរដូចខាងក្រោម៖

-ភាគីទាំងពីរនឹងនៅតែយកខ្សែបន្ទាត់Bréviéដែលបានគូសនៅឆ្នាំ 1939 ជាខ្សែបែងចែកកោះនៅក្នុងតំបន់នេះ។

- ការល្បាត និងគ្រប់គ្រងដែនទឹកប្រវត្តិសាស្ត្រនេះ ធ្វើឡើងដោយភាគីទាំងពីរ។

- ការនេសាទត្រីសមុទ្ររបស់ប្រជាជនក្នុងតំបន់នេះ នឹងនៅតែបន្តស្របតាមប្រពៃណីប្រវត្តិសាស្ត្រ។ ចំពោះ​ការ​ទាញ​យក​ធនធាន​ធម្មជាតិ​នៅ​តំបន់​នោះ ភាគី​ទាំង​ពីរ​នឹង​ចរចា​គ្នា​ទៅ​វិញ​ទៅ​មក។

កិច្ចព្រមព្រៀង​នេះ​ត្រូវ​បាន​ធ្វើ​ឡើង​នៅ​ទីក្រុង​ហូជីមិញ​នៅ​ថ្ងៃ​ទី 7 ខែ​កក្កដា ឆ្នាំ 1982 ជា​ភាសា​វៀតណាម និង​ភាសា​ខ្មែរ ដោយ​ភាគី​ទាំងពីរ​មាន​តម្លៃ​ស្មើគ្នា។

The government of the Socialist Republic of Vietnam and the government of the People’s Republic of Kampuchea, 

With the hope of consolidating and developing the special Vietnam-Kampuchea relationship, in accordance with the spirit of the Treaty of Peace, Friendship and Cooperation signed on 18/2/1979,

Based on the reality that the waters between the coast of Kien Giang province Phu Quoc island to Tho Chu Islands of the Socialist Republic of Vietnam, and the coast of Kampot province to Poulo Wai Islands of the People’s Republic of Kampuchea, include the waters that have long belonged to Vietnam and Kampuchea due to their special geographical conditions and their important meaning to the defense and economy of each country, 

Hereby agree on the following:

ARTICLE 1

The waters between the coast of Kien Giang province Phu Quoc Island to Tho Chu Islands of the Socialist Republic of Vietnam, and the coast of Kampot province to Poulo Wai Islands of the People’s Republic of Kampuchea is the historical waters of the two countries under the internal waters status, limited (according to the Greenwich meridian):

To the Northwest by the line connecting the coordinates 9°54’.2 North - 102°55' East and 9°54'.5 North - 102°57'.0 East at Poulo Wai Island (Kampuchea) to coordinate 10°24’ North - 103°48.0 East and 10°25'.6 North - 103°49'.2 East at Koh Sas Island (Kampuchea) to coordinate 10°30.0 North - 103°47'.4 East at Koh Thmei Island (Kampuchea) extended to coordinate 10°32'.4 North - 103°48'.2 East on the coast of Kampot province (Kampuchea).

To the North by the coastline of Kampot province from coordinate 10°32'.4 North - 103°48'.2 East to the extreme point on the coast of the land border between Vietnam and Kampuchea.

To the Southeast by the line connecting the extreme point on the coast of the land border between Vietnam and Kampuchea to coordinate 10°04'.2 North - 104°02'.3 East at Cape An Yen Phu Quoc Island (Vietnam) along the North coast of the Island to Cape Dat Do at coordinate 10°02.8 North - 103°59'.1 East extended through coordinate 9°18'.1 North - 103°26'.4 East at Tho Chu Island (Vietnam) to coordinate 9°15'.0 North - 103°27'.0 East at Hon Nhan Island of Tho Chu Islands (Vietnam).

To the Southwest by the line extended from coordinate 9°55'.0 North - 102°53'.5 East at Poulo Wai Island to coordinate 9°15'.0 North - 103°27'.0 East at Hon Nhan Island of Tho Chu Islands (Vietnam).

ARTICLE 2

The two sides will discuss at an appropriate time on an equal and fiendly spirit, respecting each other's independence and sovereignty, respecting each other's lawful interests to agree on the maritime  boundary between the two countries in the historical waters   mentioned in ariticle 1.

ARTICLE 3

While waiting to resolve the maritime boundary between the two countries in the historical waters mentioned in article 1:

The 0 adjacent point of the two baselines used to measure the breadth of the territorial sea of each country is on the line connecting Tho Chu Islands and Poulo Wai Island, and will be determined by the two sides by the following:

-The two sides will still take the Brévié line drawn in 1939 as the island divider line in this area.

-The patrol and control of this historical waters is conducted by both sides.

-The fishing of seafood by the local people in this area will still continue in accordance with historical tradition. In terms of extracting natural resources in the area, the two sides will negotiate with each other.

This agreement was made in Ho Chi Minh city on the 7th of July 1982, into the Vietnamese and Khmer version with both having equal value.
